| | Diplomatic Conference to adopt a Railway Protocol to the 2001 Cape Town Convention, Luxembourg, 12-23 February 2007
“Luxembourg Protocol” opens new perspectives for financing railway rolling stock
The “Luxembourg Protocol to the Convention on International Interests in Mobile Equipment on Matters specific to Railway Rolling Stock” adopted on 23 February 2007 at a Diplomatic Conference held in Luxembourg under the auspices of the International Institute for the Unification of Private Law (UNIDROIT) and OTIF contains provisions for setting up an International Registry in which railway equipment and any interests creditors have in it can be registered, thus ensuring effective international legal protection. This will facilitate access to the private financing of locomotives, tram sets, special freight wagons and other valuable railway equipment. The Protocol will enter into force once it has been ratified by four States, provided that OTIF, as the Secretariat of the Supervisory Authority for the “International Registry”, confirms that it is fully operational.
